WHAT IS SURROGACY?

Surrogacy is a process where intended parents enlist the help of a surrogate mother to conceive, carry and nurture a child until childbirth. The process of surrogacy is undertaken in cases where the couple cannot naturally produce a child, or there is some form of deficiency either in the mother or the father. Thus, surrogacy offers an option to have a biological child even to those couples/individuals who have been unable to carry a pregnancy to term.

There are two types of surrogacy-

1.) Traditional Surrogacy- In this process, the surrogate mother uses her own egg cells for the conception of the child and the intended father would be the sperm donor. Under traditional surrogacy the process is done through artificial insemination in a fertility clinic.

2.) Gestational Surrogacy- This is where a Surrogate Mother carries a pregnancy resulting from the transfer of embryos that have been created by IVF using the egg and sperm of the biological parents. In this process the surrogate mother only acts as a vessel for the fertilized egg until childbirth. The carrier (i.e. the surrogate) is not genetically related to the child.

The possible options under a Gestational Surrogacy are as follows:

  • Mother’s egg, Father’s sperm- This option is chosen when the biological mother has been unable to carry a child for medical reasons but is able to produce sufficient quantity and suitable quality of eggs
  • Donor’s egg, Father’s sperm- This option is chosen when the intended mother’s eggs cannot be used due to quantity or quality issues
  • Mother’s egg, Donor’s sperm- This option is chosen when the quality of the father’s sperm is questionable
  • Donor’s egg, Donor’s sperm- This option is chosen when both parents have a fertility challenge


INDICATIONS FOR SURROGACY

A patient may be advised surrogacy on the following grounds-

  • The patient has had the uterus removed (hysterectomy), due to cancer, severe haemorrhage or ruptured womb
  • The patient has a malformed uterus or the lining of the womb is damaged
  • The patient suffers from health problems (such as diabetes, heart or kidney disease) that may result in life threatening pregnancy
  • The patient has had repeated miscarriages despite all possible treatments
  • The patient has had multiple IVF failures due to failed implantation


ABOUT SURROGACY IN INDIA

Commercial Gestational surrogacy is legal in India and supported by the Indian government.

All couples can avail this facility to fulfill their dream of enjoying parenthood.

There are sufficient rules and regulations in place to safeguard the interest of the surrogate as well as the intended parent. The surrogate mother (and her husband, in case she is married) sign a written, notarized consent, where-in they give an undertaking that they shall not have any claims towards the paternity of the child delivered by the surrogate . The biological parent/s sign a contract with the surrogate mother, and are responsible to pay for her monthly bills of food, medicines, transportation during the duration of the surrogacy program and her final compensation at the end of the program. These costs are clearly mentioned in the contract (and also the payment schedule) that is signed at the beginning of the program itself.

The laws for surrogacy in India are very simple and favor the intended parents while safeguarding the interests of the surrogate and her family. The cheaper availability of surrogates accompanied with higher success rates of surrogate pregnancies in India is also attracting a lot of interest. Surrogacy in India is becoming an increasingly popular alternative for couples from Australia, UK, USA, Canada, France, Iraq, Bangladesh and a lot of Middle Eastern and European countries.

Surrogacy costs in India for a single successful round start at US$25,000 with success rates as high as 50% depending on the age of the woman. When egg-donors are used the success rate jumps to 80%.


SCREENING AND SELECTION OF SURROGATES AND EGG DONORS

1.) The surrogates are recruited against meticulous and stringent criteria and are regularly monitored by the doctor/hospital. All surrogates taken into the program are between 21-35 years of age. These are women with previous normal deliveries and healthy babies. The Surrogates are tested to confirm they are free of HIV, hepatitis B and C infections, sexually transmitted diseases, hypertension, diabetes and other diseases. They are also run through serological screening and thalessemia screening. History of blood transfusion and addiction is also taken into account before recruiting a surrogate.

2.) The surrogates medical history, personal history and family history is looked into. All surrogates are pre-screened by a team of medical experts and psychiatrists to ensure that they are physically and mentally fit and ready to be a surrogate. The surrogate (and her husband, in case she is married) have to undergo counselling sessions so as to make them familiar with the complete surrogacy program.

3.) Egg/Sperm donors are tested to confirm they are free of HIV, hepatitis B and C infections, sexually transmitted diseases, hypertension, diabetes and other diseases. They are also run through serological screening and thalessemia screening. History of blood transfusion and addiction is also taken into account before choosing an egg-donor.

Only those women who meet all the criteria are selected as egg-donors/surrogates.


THE PROCESS

The surrogate is started on Estrogen tablets to prepare her endometrium from the first day of her menses. Subsequently, Gonadotropin injections are started for the genetic mother from day 1 of her menses. The genetic mother has to take an injection daily for approximately 10 days by which time mature eggs are formed in both her ovaries. The egg pick-up is done around Day 13 and the genetic father is required to give his semen sample on that day. An ultrasound guided embryo transfer is done for the surrogate by Day 15. She is then put on luteal support and a pregnancy test is done after 15 days to confirm if she is pregnant. Special care is given to the surrogate and regular tests are done to monitor the health and growth of the baby. Regular updates about the surrogate’s health and baby’s progress are provided by email. After birth, the baby is immediately handed over to the Genetic parents/Intended parent. The birth certificate is issued in the name of the Genetic parents/Intended parent.
